Last Updated: December 15, 2024

1. Introduction and Acceptance of Terms

Welcome to toll m50 flow, operated by M50 Toll Solutions Ltd. These Terms of Service constitute a legally binding agreement between you and M50 Toll Solutions Ltd., governing your access to and use of our electronic toll collection payment system for the M50 motorway in Ireland.

By accessing our website at https://toll-m50-flow.com, creating an account, registering your vehicle, making payments, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

These terms apply to all users of the service, including but not limited to individual motorists, fleet operators, business account holders, and any other parties who interact with our platform. We reserve the right to modify these terms at any time, and your continued use of the service following any changes constitutes acceptance of those modifications.

Important Notice:These terms are effective as of the date stated above. We recommend reviewing these terms periodically to stay informed of any updates or changes that may affect your use of our services.

2. Service Description and Scope

M50 Toll Solutions Ltd. provides an electronic toll collection and payment management system specifically designed for the M50 motorway toll plaza in Ireland. Our comprehensive service platform enables motorists to efficiently manage their toll obligations through a variety of convenient methods and features.

Core Services Provided

Our platform offers the following primary services to registered users: online account registration and management, vehicle registration with the ability to add multiple vehicles to a single account, trip recording and tracking for all M50 toll plaza passages, flexible payment options including prepaid accounts and pay-as-you-go arrangements, automated toll charge processing and billing, detailed transaction history and reporting, account balance monitoring and top-up facilities, and comprehensive customer support services.

Users can access their accounts through our secure web portal, where they can view real-time information about their toll usage, make payments, update vehicle information, manage payment methods, and access historical records of all transactions. The system automatically records each passage through the M50 toll plaza using advanced vehicle recognition technology, ensuring accurate billing and comprehensive trip documentation.

Payment Processing and Account Management

We offer multiple payment methods to accommodate different user preferences and requirements. Users may choose to maintain a prepaid account balance, which is automatically debited for each toll passage, or opt for periodic billing arrangements where charges are accumulated and billed at regular intervals. Payment can be made through various channels including credit cards, debit cards, direct debit arrangements, and online banking transfers.

The service includes automated low balance notifications, ensuring users are alerted when their account balance falls below a specified threshold. This proactive approach helps prevent service interruptions and ensures continuous toll payment coverage. Users can set up automatic top-up arrangements to maintain a minimum balance, providing peace of mind and uninterrupted service access.

3. Account Registration and User Obligations

To utilize our services, users must create an account by providing accurate, complete, and current information as requested during the registration process. You are responsible for maintaining the confidentiality of your account credentials, including your username and password, and for all activities that occur under your account.

Registration Requirements

During registration, you must provide your full legal name, valid email address, current residential or business address, contact telephone number, and accurate vehicle registration details including registration numbers and vehicle types. All information provided must be truthful and accurate. Providing false or misleading information constitutes a breach of these terms and may result in account suspension or termination.

You must be at least 18 years of age to register for an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this binding agreement. If you are registering on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

Account Security and Responsibility

You are solely responsible for maintaining the security of your account credentials and for all activities conducted through your account, whether authorized by you or not. You must immediately notify us of any unauthorized access to your account or any other security breach. We recommend using a strong, unique password and enabling any additional security features we may offer, such as two-factor authentication.

You agree not to share your account credentials with any third party or allow others to access your account. Each account is intended for use by a single individual or entity. If we detect suspicious activity or believe your account security has been compromised, we reserve the right to temporarily suspend your account and require additional verification before restoring access.

User Responsibility:You are responsible for ensuring that all vehicle information registered to your account is accurate and up-to-date. Failure to maintain current vehicle details may result in incorrect toll charges or payment processing issues.

4. Payment Terms and Toll Charges

By using our service, you agree to pay all applicable toll charges incurred by vehicles registered to your account when passing through the M50 toll plaza. Toll rates are determined by vehicle classification and are subject to change in accordance with applicable regulations and pricing policies.

Toll Charge Processing

Toll charges are automatically recorded when your registered vehicle passes through the M50 toll plaza. The system uses advanced vehicle recognition technology to identify your vehicle and associate the passage with your account. Charges are typically posted to your account within 24 hours of passage, though processing times may vary depending on system load and technical factors.

For prepaid accounts, toll charges are immediately deducted from your available balance. For periodic billing arrangements, charges accumulate during the billing cycle and are billed according to your selected payment schedule. You are responsible for ensuring sufficient funds are available in your account or payment method to cover all toll charges and any associated fees.

Payment Methods and Processing

We accept payment through various methods including major credit cards (Visa, Mastercard, American Express), debit cards, direct debit from Irish bank accounts, and online banking transfers. When you provide payment information, you authorize us to charge your selected payment method for all applicable toll charges, fees, and any other amounts owed under these terms.

You are responsible for ensuring that your payment information remains current and valid. If your payment method expires or is declined, you must promptly update your payment information to avoid service interruption. We reserve the right to suspend or terminate accounts with outstanding balances or repeated payment failures.

Late Payments and Additional Charges

Failure to pay toll charges within the specified timeframe may result in additional fees and penalties as permitted by applicable law and regulations. Late payment fees are designed to cover administrative costs associated with collection efforts and to encourage timely payment. Continued non-payment may result in account suspension, referral to collection agencies, and potential legal action.

If you believe a toll charge has been applied in error, you must notify us within 30 days of the charge appearing on your account. We will investigate all disputed charges and make appropriate adjustments if an error is confirmed. However, you remain responsible for payment of all undisputed charges during the investigation period.

5. Vehicle Registration and Management

All vehicles that will use the M50 toll plaza under your account must be properly registered with accurate and complete information. You may register multiple vehicles to a single account, and you are responsible for maintaining current information for all registered vehicles.

Vehicle Information Requirements

When registering a vehicle, you must provide the complete vehicle registration number, vehicle make and model, vehicle classification (car, van, truck, etc.), and any other information required by our system. The vehicle registration number must exactly match the registration displayed on the vehicle. Inaccurate or incomplete vehicle information may result in toll charges not being properly associated with your account, potentially leading to additional fees or penalties.

You must immediately update your account if any vehicle information changes, including if you sell or dispose of a vehicle, change registration numbers, or modify vehicle classification. Failure to remove a vehicle from your account after sale or disposal may result in you being charged for toll passages made by the new owner until the vehicle is properly removed from your account.

Authorized Use of Registered Vehicles

By registering a vehicle to your account, you represent that you are the legal owner or authorized user of that vehicle and have the right to register it for toll payment purposes. You are responsible for all toll charges incurred by registered vehicles, regardless of who is driving the vehicle at the time of passage through the toll plaza.

If you allow others to drive your registered vehicles, you should inform them that the vehicle is registered for automatic toll payment and that all passages will be charged to your account. You remain fully responsible for all charges incurred by your registered vehicles, and disputes regarding who was driving at the time of passage do not relieve you of payment obligations.

6. Service Availability and Technical Support

We strive to maintain continuous availability of our services and website, but we cannot guarantee uninterrupted access at all times. Our services may be temporarily unavailable due to scheduled maintenance, system upgrades, technical difficulties, or circumstances beyond our reasonable control.

System Maintenance and Downtime

We reserve the right to perform scheduled maintenance on our systems, which may result in temporary service interruptions. We will make reasonable efforts to schedule maintenance during off-peak hours and provide advance notice when possible. However, emergency maintenance may be performed without prior notice if necessary to maintain system security or functionality.

During periods of system unavailability, toll charges will continue to be recorded and processed once systems are restored. You remain responsible for all toll charges incurred during any service interruption, and inability to access your account online does not excuse payment obligations.

Customer Support Services

We provide customer support services to assist users with account management, payment issues, technical difficulties, and general inquiries. Support is available through multiple channels including telephone at +353 1 403 3535, email at support@toll-m50-flow.com, and through our online contact form available on thecontacts page.

For urgent payment or account issues, we recommend contacting us by telephone for the fastest resolution.

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and whether or not we have been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Any prepaid balance remaining in your account after all charges have been settled may be refunded to you, subject to our refund policy and applicable processing fees. Account closure does not relieve you of any obligations incurred prior to closure.

Before closing your account, you should remove all vehicles from your registration and ensure that no vehicles will continue to use the M50 toll plaza under your account. You remain responsible for any toll charges incurred by vehicles registered to your account until they are properly removed from the system.

Upon termination of your account, your right to use the service will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
